Florida Family HHA Program: Legislative Fix in Progress for Florida’s Medicaid Policy

The Family Home Health Aide program under House Bill 391 became law in Florida in 2023, creating new opportunities for family members to provide care in the home. However, one significant concern remained: income earned through the program by a family member living in the home was still being counted toward the household’s Medicaid income limit—potentially affecting eligibility for critical services.

To address this, the Florida Legislature recently passed a corrective bill requiring the Agency for Health Care Administration (AHCA) to submit a waiver request to the federal Centers for Medicare & Medicaid Services (CMS). This waiver would allow the income earned by an in-home family caregiver to be disregarded when determining Medicaid eligibility.

While this is a crucial step forward, CMS approval may take several months. Until that approval is granted, the income will continue to be counted toward Medicaid income limits.
